Flow of Trademark Registration
Please let us know the name or logo you are considering for trademark registration. Please tell us about the products or services for which you wish to use the name or logo. If you have already created a website or brochure for the products or services, please let us know as well.
We conduct a preliminary search to see if the mark is likely to be registered as a trademark and if similar trademarks have already been registered by other companies.
The search is conducted by experienced patent attorneys.
Based on the prior search, we will formulate and propose a trademark registration policy and strategy, suggesting which trademark (name/logo) should be combined with which products/services for registration.
We will send the formulated strategy to you for your confirmation.
Once you have confirmed the contents, we will submit the documents for trademark application to the Japan Patent Office (JPO).
Submission to the JPO is done online via a dedicated terminal installed in our office.
About 6 to 8 months after filing, you will receive the examination results from the JPO.
Results will be either a “Notification of Reasons for Refusal” or a “Decision to Grant Registration.
If a Notification of Reasons for Refusal is received, we will draft a Written Opinion/Amendment to counterargue. Experienced patent attorneys provide full support for creating these counterarguments.
Once a Decision to Grant Registration is received, we perform the final registration procedures. The registration period can be selected as 10 years or 5 years.
Upon completion, the “Certificate of Registration” will be sent to our office. We will forward it to you upon receipt.
A trademark right can be maintained for 10 years (or 5 years) from the registration date.
This duration can be renewed and extended by performing renewal procedures and paying additional registration fees by a prescribed deadline.
If renewal procedures are not performed by the deadline, the trademark right will expire.
